1. Acceptance of Terms
By creating an account, accessing, or using Nestbord (“the Platform”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you disagree, you may not use the Platform.
2. About Nestbord
Nestbord is a property management software platform that enables landlords, property managers, agents, and tenants to manage rentals, payments, communication, maintenance, and related activities.
Nestbord does not provide legal, financial, or real estate services.
3. Eligibility
To use Nestbord, you must:
Be at least 18 years old.
- Provide accurate, complete, up-to-date information.
- Use the Platform for lawful purposes only.
- Landlords are responsible for ensuring compliance with provincial and federal housing regulations.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials.
You agree to:
Notify Nestbord immediately of any unauthorized use.
Ensure all information submitted is accurate and lawful.
Do not impersonate another person or provide false details.
Nestbord is not responsible for losses caused by unauthorized account access.
5. Platform Use & Restrictions
You agree not to:
Use the Platform for fraudulent, harmful, or unlawful activities.
Upload false documents or misleading information.
Attempt to access other users’ accounts, data, or private information.
Interfere with platform operations or security.
Reverse engineer, copy, or redistribute the software.
Nestbord may suspend or terminate accounts violating these Terms.
6. Property Listings & Tenant Applications
Landlords are solely responsible for:
The accuracy of property information, pricing, and listing details.
Compliance with rental laws in their province or country.
Screening and selecting tenants in compliance with fair housing rules.
Publishing or sharing listings via the Platform.
Nestbord is not liable for rental decisions, disputes, or housing outcomes.
7. Payments & Rent Collection
Nestbord provides payment tools for recording and facilitating payments through trusted third-party processors.
By using payment features, you agree to:
Provide accurate payment instructions.
Use payment methods permitted by your jurisdiction.
Comply with all banking, financial, and anti-fraud regulations.
Nestbord does not handle funds directly unless operating through an authorized payment processor.
Payment processing times and fees depend on third-party providers.
Nestbord is not responsible for:
Failed, delayed, or misdirected payments.
Bank transfer disputes or chargebacks.
Transfer errors initiated by tenants.
8. Fees & Billing
Certain features may require a paid subscription.
By subscribing, you authorize Nestbord to charge your payment method for fees, taxes, and renewals.
Subscription fees are:
Non-refundable unless required by law.
Subject to change with notice.
You may cancel your subscription at any time, but cancellation does not refund previous charges.
9. Maintenance Requests & Communication Tools
Landlords and tenants are responsible for the content of messages and requests submitted through the Platform.
Landlords may assign vendors or staff to manage repairs.
Nestbord is not responsible for:
Maintenance work quality or timing.
Scheduling or communication issues between parties.
Damage, injury, or disputes arising from vendor involvement.
All communication between parties is their sole responsibility.
10. Documents, E-Signatures & Storage
Nestbord may allow users to store documents, upload files, and execute electronic signatures.
You agree that:
Uploaded documents must be lawful and accurate.
E-signatures executed through the Platform meet applicable legal requirements.
Nestbord does not guarantee legal enforceability of any documents; you are responsible for verifying legal enforceability in your jurisdiction.
11. Data Protection & Privacy
Nestbord complies with applicable data protection laws.
By using the Platform, you consent to:
The collection, use, and storage of personal information, required to operate the service.
Sharing information with payment providers, screening partners, or other integrated tools as necessary.
We implement reasonable safeguards, such as encryption, secure hosting, and access controls.
No system is completely secure, and Nestbord cannot guarantee absolute protection against breaches.
12. Third-Party Services
Nestbord integrates with third-party payment processors, screening providers, cloud storage services, and other external tools.
You acknowledge that:
Third-party terms apply.
Nestbord is not responsible for third-party errors, outages, or data breaches.
13. Intellectual Property
All content, features, and technology on Nestbord are owned by Nestbord and protected by copyright and trademark laws.
You may not copy, modify, or redistribute content without written permission.
14. Termination
Nestbord may suspend or terminate access without notice for:
Violations of these Terms
Fraudulent or harmful activity
Misuse of the Platform
Security concerns
Failure to comply with legal obligations
Users may also request account deletion at any time.
15. Limitation of Liability
To the maximum extent permitted by law:
Nestbord is not liable for indirect, incidental, or consequential damages.
Nestbord is not responsible for rental decisions, landlord-tenant disputes, legal compliance, payment failures, maintenance issues, financial losses, and housing outcomes.
Your use of the Platform is at your own risk.
16. Indemnification
You agree to indemnify and hold Nestbord harmless from claims, losses, or liabilities arising from:
Misuse of the Platform
Violations of law or these Terms
Disputes between landlords, tenants, or vendors
Content or documents you upload or share
17. Changes to Terms
Nestbord may update these Terms periodically as we continue to improve Nestbord.
Continued use of the Platform after changes indicates acceptance of the latest updated Terms and Conditions version.
18. Governing Law
These Terms are governed by the laws of Canada and the province of Saskatchewan, without regard to conflicts of law principles. Nestbord operates nationally, and users across all provinces and territories agree to resolve any disputes under this governing jurisdiction.
